18orup Inc. Terms & Conditions
As used on this website, the following terms have the meanings set forth as follows: "Company" means 18orup Inc. or any related entity. "Site" means 18orup.com, any sub-domain of 18orup.com (please see paragraph 1 of our Privacy Policy), and any site affiliated with 18orup.com as to which these Terms and Conditions apply. "Member" means the user of a valid username and password to access the Site during the term of Membership (as defined below). "Content" means any text, printed material, digital or analog audio, photographs, digital images, electronic images, illustrations, paintings, portraits, negatives, digital or analog video, and any other type of matter, known or unknown, capable of reproducing images either individually, or in sequence that conveys motion or the impression of motion, and with or without sound, appearing on the Site. "You" and "your" refer to the Member or any other user of the Site. "Membership" means the period of time during which a Member has paid for access to the Site and which access has not been cancelled or terminated for any breach hereunder; or, if access is granted without the necessity of payment, the period of time during which a Member is in good standing and is granted access to the Site provided such Member has otherwise complied with the Terms and Conditions herein and which access has not been cancelled or terminated for any breach hereunder. The Company does not guarantee the truthfulness, accuracy, or reliability of communications posted by Members or otherwise and does not endorse any of their opinions. You acknowledge that you rely on material posted by other Members at your own risk. The Company is not responsible for the screening or monitoring of material posted by users. The Company may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes such information may create liability for the Company or may cause the Company to lose the services of its ISP's or other suppliers. E. Content Ownership You are authorized to access and view the Content solely for your personal (noncommercial) use. The Content and programming of the Site are protected both under United States and foreign copyright laws. You shall not copy, adapt, modify, reverse engineer, display, perform, distribute, or otherwise make use of any of the Content for any reason whatsoever, whether or not such Content is protected by copyright, without the written consent of the Company and, if applicable, of the copyright holder, except as provided herein. Memberships A Membership for an "Applicant", as described on the Site is free and payment information is not required, except in connection with the purchase of additional goods and services that may be offered from time to time. This Membership includes the ability to compile and store and online "portfolio" consisting of resumes, pictures, contact information, etc. A Membership for an "employer", as described on the Site is subject to charges from time to time, at the rates and for the periods identified on the Site. Under no conditions may a Membership exceed sixty (60) months, at which time the Member will be asked to complete the then applicable sign-up procedure again. The Company may terminate an Employer's Membership for any reason or no reason. If an Employer cancels a Membership or if a Membership is terminated by the Company (unless for a violation of these Terms and Conditions or for other cause), the Employer's Membership will extend through the end of the then-current billing period. The Employer agrees that if the Employer cancels a Membership prior to its expiration date, no refund of any Membership Fees will be given, pro-rated or otherwise and the Employer will be charged for the full term of Membership. All charges to a Member's credit card are non-refundable. You hereby authorize 18orup Inc. to automatically make charges to your chosen payment method for ongoing monthly Membership Fees at the times and in the amounts described on the Site, as well as for any and all additional purchases of goods and services made through the Site. You are fully responsible for maintaining the confidentiality of your information and password. You shall be responsible for all use of your membership. You agree to immediately notify the company of any unauthorized use of your membership. H. Notices The Company may, from time to time, update its policies or provide news or information by e-mail to your e-mail address on file or by a general notice on the site. You may use the customer service links available on the Site or e-mail the Company with any questions, complaints, or notices at support@18orup.com You agree to keep your contact information current and update it as necessary. I: No Warranty The Company does not warrant that the Site will operate all or substantially all of the time (no "uptime" guarantee) or that all of the links or advertised services will operate or be available. You are responsible for securing your computer against viruses, malware, Trojan horses, bots, spyware, worms, and all other harmful or malicious programs that may corrupt or erase your data and applications, use your machine (either individually or as part of a scheme) for the distribution of harmful or malicious programs to other machines, or appropriate your personal information. The Company shall assume no liability for any such harm or damage, whether or not your have secured your computer appropriately.
